Sunny Leone Fraud Case: Court Says Dispute Is a Business Matter, Dismisses Cheating Complaint

In connection with the fraud case filed against Sunny Leone and her husband, the court opined that there is no case of cheating against them and that the whole matter relates to business dealings only.

The complainant alleged that he had helped Sunny Leone get into the Telugu film industry. It was said by him that there was an agreement between the two of them for an aggregate amount of ₹1.75 crore (17.5 million rupees). The complainant alleged that according to the deal, he was to get a certain percentage as commission from the total amount.

The complainant alleged that although he got some money, the rest was left unpaid. He filed a criminal case against Sunny Leone and other accused persons under sections 406, 420, and 506 (II) of the Indian Penal Code.

The Judicial Magistrate First Class Court in Andheri dismissed Jain's complaint on October 10, 2024. He subsequently challenged this decision in the Dindoshi court. Jain alleged that the Magistrate Court dismissed his complaint without properly examining it.

During the hearing of the case, the Sessions Court examined documents, tax invoices, and correspondence between the parties. The court stated that all of these evidence clearly demonstrates that the dispute relates to a commercial transaction.

The court stated that a contract existed between the parties, and the issue involved a mere non-fulfillment of a term of that contract. Therefore, it cannot be considered a case of criminal fraud. The court also stated that the complainant failed to provide sufficient evidence of cheating or criminal breach of trust.

The court stated that the Magistrate Court's decision contained no illegality, material error, or flaw that warranted a reversal. The court subsequently dismissed Jain's revision application. This decision also dismissed the cheating complaint against Sunny Leone, her husband, and manager.
