Netflix: No ban on streaming of Tribhuvan Mishra CA Topper, Delhi HC rejects petitioner's claims
Netflix: The Delhi High Court has refused to ban the streaming of the Netflix series 'Tribhuvan Mishra CA Topper'. The judge has termed the petitioner's claims as baseless.
The Delhi High Court has refused to ban the streaming of the Netflix series 'Tribhuvan Mishra CA Topper'. The series was accused of portraying the profession of chartered accountancy in a derogatory manner. However, the court says that it is in the genre of comedy and cannot be considered derogatory to the profession of chartered accountancy.
The High Court issued notice to Netflix and others on a petition filed by the Institute of Chartered Accountants of India (ICAI) and four chartered accountants (CAs), which said that the portrayal of the profession in a derogatory manner is bound to defame the profession. However, after watching the trailer of the web series, Justice Naveen Chawla said that he did not find any prima facie case to grant interim injunction in favor of the plaintiffs at this stage.
Justice Naveen Chawla said, 'In my prima facie view, I do not think that the trailer is in any way referring to the profession of chartered accountancy. It is a series that appears to be more in the genre of comedy and only describes the main character as a topper in the chartered accountancy examination. The judge further said, 'It is neither intended nor can be construed as derogatory to the profession of chartered accountancy or the toppers or rank holders in the examination conducted by the plaintiff number.'
The plaintiffs are angry since the trailer of the serial was released. The trailer announced the release of the series on Netflix on July 18. They claimed that the trailer depicted the profession of chartered accountancy in an extremely vulgar and derogatory sense. The plaintiffs complained that portraying the profession in such a reprehensible manner is completely illegal and a violation of their constitutional rights.
At the same time, Netflix's lawyer said that the web series is completely fictional and there is also a disclaimer at the beginning of it which declares that it does not contain any reference to any person or any real person, dead or alive. The lawyer said that within five days, the platform will also add a disclaimer that no reference has been made to any profession in the series.
