‘Kahaani 2’ Row: SC Quashes Proceedings Against Filmmaker Sujoy Ghosh

Sujoy Ghosh has received a major relief in the alleged copyright infringement case related to the film 'Kahaani 2'. The Supreme Court has dismissed the case against the producer. According to news agency PTI, the Supreme Court on Friday dismissed the proceedings against filmmaker Sujoy Ghosh in a Jharkhand court in the alleged copyright infringement case related to his film 'Kahaani 2'.
According to PTI, Justice P.S. A bench of Justices Narasimha and Alok Aradhe admitted Sujoy Ghosh's petition challenging an order of the Jharkhand High Court (dated April 22, 2025) that refused to quash the proceedings pending against the producer. Accepting Ghosh's petition, the bench stated, "The summons order issued by the Chief Judicial Magistrate (CJM) on June 7, 2018, and the order issued by the High Court on April 22, 2025, are quashed."
In July last year, the Supreme Court issued a notice to the Jharkhand government on Ghosh's petition seeking dismissal of the case pending before the CJM court in Hazaribagh. The filmmaker had approached the High Court challenging the CJM court's order, which had found a prima facie case of copyright infringement against him under Section 63 of the Copyright Act, 1957. The High Court dismissed Sujoy Ghosh's petition, stating that it would not conduct a "mini-trial" at this stage of dismissal and that these issues could be examined during the trial.
The complainant, Umesh Prasad Mehta, had written a script for the film "Sabak," which was certified by a Hazaribagh notary public to obtain its copyright. It was alleged that the complainant met Sujoy Ghosh and obtained a recommendation letter, which is required to obtain copyright for a film script. It is alleged that Ghosh kept a photocopy of the complainant's script and deliberately infringed the complainant's copyright by making the film "Kahaani 2." The complainant watched the film at a film hub in Hazaribagh. After watching the film, the complainant alleged that Ghosh had stolen his script and violated his copyright. Regarding the film "Kahaani 2," it starred Vidya Balan and Arjun Rampal.
